Samsung denied preview of iPad 3, iPhone 5 in ongoing Apple infringement suit

jedwan A US district judge this week handed Apple a victory in its ongoing legal battle with Samsung, denying the latter its reciprocal discovery request for a peek at prototypes of the upcoming versions of the iPhone and iPad. The request followed a similar one filed by Apple, in order to view Samsung products, including the Galaxy S II, Galaxy Tab 8.9, Galaxy Tab 10.1, Infuse 4G, and Droid Charge. Samsung, for its part, argued that taking an early look at the Apple’s upcoming phone and tablet would be relevant to the legal ruling, seeing as how any changes made in those upcoming products would affect the trade dress (“total product image”) of the line, and thereby potentially alter the possibility of consumer confusion, an important factor in determining infringement with certain unregistered trademarks with the product. The court denied Samsung’s motion on a number of grounds. For one thing, Apple’s initial complaint pertained to infringement of existing products, parameters deemed legit by the court. Also, the court took into account the fact that Apple tends to be far more tight-lipped about its product releases, whereas Samsung made a point of offering up information about forthcoming products into the public domain, including the release of 5,000 Galaxy Tab 10.1 units as samples to the public. That said, the judge was careful to note that Apple’s suggestion that court protection of its trade secrets was insufficient “is not well taken.” More details after the break. Samsung Galaxy S II for AT&T ratted out by its own HDMI dock

jedwan Oh, we’ve been fairly certain for a while now that we’d see the sexy Samsung Galaxy S II saunter on over to AT&T, but now we’ve attained what appears to be the first official photo of the handset. Samsung’s Singapore division has a series of professional shots of planned accessories, including this “Samsung Galaxy S II Desktop Dock,” a handsome pyramid stand sporting HDMI and 3.5mm stereo-out jacks — and of course, an AT&T logo on its comfortably cradled smartphone. We’re still not quite sure when Samsung’s flagship will hit the US, but it had better get a move on — we’re slated to see a Galaxy S III by this time next year, after all. jedwan Inspire is a nice phone, and if you’ve been an HTC fan for this long (like me) you might want to keep it that way. Motorola phones have been underwhelming to me for some time now. While I haven’t handled the Atrix in person, other recent Moto phones just feel cheap, plasticky, and clunky. And I’ve read comments that the Atrix (while an improvement) is still not up to HTC’s current excellent build quality. Samsung makes pretty nice hardware, but still not up to par with HTC as far as the phone casing (but the Samsung displays are top notch). The other rub is that Samsung software support is horrible. They are the slowest at releasing updates, and TouchWiz stinks compared to Sense (as does Moto Blur). If you read around, the Galaxy S series (including the Captivate) has had a ton of software problems which cause UI lag and poor GPS reception. Not sure if there are any issues like this with the new Infuse. But you might want to investigate it, if you are interested in that device. Plus, if developer support like mods and custom ROMs are an interest to you, HTC devices still get the bulk of the attention.
